3. Coach Connections: Minors may only connect with coaches if their
parent/guardian has approved the coach connection and consented to data
sharing.

4. Parental Controls: Parents/guardians may request access to or deletion of
their minor child's data by contacting support@pegasusrealm.com.

InkWell™ is NOT a substitute for professional mental health care. We explicitly
disclaim any liability for:

1. Self-Harm or Suicide: InkWell is not monitored for crisis situations. If
you are experiencing suicidal thoughts, call 988 (US) or your local crisis
line immediately.

2. Diagnosis or Treatment: Coaches on InkWell are not providing mental health
diagnosis, treatment, or therapy. Any insights or reflections are for
personal growth only.

3. Coach Conduct: Coaches are independent contractors. Pegasus Realm is not
liable for coach misconduct, negligence, boundary violations, or breaches
of professional ethics.

4. AI Errors: Sophy AI may produce inaccurate, inappropriate, or harmful
reflections. We are not liable for any actions you take based on AI
suggestions.

User comments, feedback & other submissions

If, at our request, you send certain specific submissions (for example contest entries) or without a request from us you send creative ideas, suggestions, proposals, plans, or other materials, whether online, by email, by postal mail, or otherwise (collectively, ‘comments'), you agree that we may, at any time, without restriction, edit, copy, publish, distribute, translate and otherwise use in any medium any comments that you forward to us. We are and shall be under no obligation (1) to maintain any comments in confidence; (2) to pay compensation for any comments; or (3) to respond to any comments.

We may, but have no obligation to, monitor, edit, or remove content that we determine in our sole discretion are unlawful, offensive, threatening, libelous, defamatory, pornographic, obscene or otherwise objectionable or violates any party's intellectual property or these Terms of Service.

InkWell, BreathLab Pro, and other apps:

1. Ownership: You retain all rights to your journal entries, goals, and
uploaded content ("User Content"). Pegasus Realm does not claim ownership.

2. License to Operate: By using InkWell, or any Pegasus Realm app,  you grant Pegasus Realm a limited
license to store, process, and display your User Content solely to provide
the Services (e.g., syncing across devices, generating AI reflections,
sharing with your connected coach).

3. No AI Training: Your journal entries will NOT be used to train AI models
or improve Anthropic's services. We do not share User Content with third
parties except as necessary to operate the Services.

4. Anonymized Analytics: We may use anonymized, aggregated data (e.g.,
"50% of users journal daily") for internal analytics and marketing, but
never in a way that identifies you personally.

5. Prohibited Content: You may not use InkWell, or any Pegas Realm product or service to store illegal content,
including child sexual abuse material, terroristic threats, or content
that violates others' rights. We reserve the right to report illegal
content to authorities.

AI Tools, Prompts, and Responses

Some services offered by Pegasus Realm—including, but not limited to, Thrive Scribe, the Aloha Wellness Guide GPT companion, and any other website or mobile application provided by us—include features powered by artificial intelligence (AI). These may include the generation of journaling prompts, reflections, insights, or other interactive content through third-party AI models (e.g., OpenAI’s GPT-based services or similar platforms).

No Professional Advice

All AI-generated content is provided for personal reflection and educational purposes only. It is not a substitute for professional mental health, legal, financial, or medical advice. While these tools may assist in personal growth and wellness, they are not reviewed or moderated by licensed professionals unless explicitly stated. You agree that you will not rely on AI responses for diagnostic, therapeutic, emergency, or high-stakes decision-making.

User Responsibility and Discretion

You retain full responsibility for how you interpret and use any AI-generated content. You agree that all content entered into AI prompts is done voluntarily and at your discretion. You may choose to delete or retain your entries at any time within the available app settings.

Data Handling and Security

We take reasonable precautions to secure user-submitted content, including journal entries and uploads, but Pegasus Realm makes no guarantees as to the confidentiality of material shared with AI systems. We recommend you do not include sensitive personal data (e.g., medical information, passwords, or financial details) in your prompts or journaling entries.

Non-HIPAA Compliance

Pegasus Realm tools are not HIPAA-compliant. Users should not enter Protected Health Information (PHI), and doing so may violate these terms. We disclaim all responsibility for the storage, processing, or potential exposure of any such information entered into our services.

Third-Party AI Processing:

InkWell uses Anthropic's Claude AI to generate
prompts, reflections, and insights. By using Sophy (our AI companion), you
consent to your journal entries being processed by Anthropic's servers.
Anthropic's Privacy Policy applies: [link].

AI Limitations: Sophy is an AI tool, not a human therapist. AI-generated
reflections may contain errors, misinterpretations, or inappropriate
suggestions. You should not rely on Sophy for crisis intervention or
emergency mental health support.

Crisis Resources: If you are experiencing a mental health emergency,
contact 988 Suicide & Crisis Lifeline (US), 911, or your local emergency
services. InkWell is not monitored 24/7 and cannot provide crisis support.

Limitation of Liability

Pegasus Realm disclaims all liability for harm, injury, emotional distress, or losses allegedly caused by use of AI tools or prompts. By using any of our AI-enhanced services, you agree to hold Pegasus Realm harmless for any outcomes resulting from your engagement with AI content.

Eligibility; Registration and Account Security.

1. The Services are intended solely for users who are eighteen (18) years of age or older or a legal guardian. Any registration by, use of or access to the Services by anyone under eighteen (18), without a legal guardian, is unauthorized and in violation of this Agreement. By registering for or using the Services, you represent and warrant that you are eighteen (18) years of age or older, or a legal gaudian of any minor using our services.

2. If you use the Services on behalf of another party, company or other organization, you represent and warrant that you are authorized to bind such party, company or organization to this Agreement and to act on behalf of such party, company or organization with respect to any actions you take in connection with the Services.

3. You agree to (i) provide accurate, current and complete information about you and your organization (if applicable) as prompted by the registration forms ("Registration Data"); (ii) maintain the confidentiality of your password and other information related to the security of your account; (iii) maintain and promptly update the Registration Data and any other information you provide to Pegasus Realm, to keep such information accurate, current and complete; and (iv) be fully responsible for all use of your account and for any actions that take place through your account.

We may make certain products and services available for purchase on the Sites. If you order any products or services, you hereby represent and warrant that you are 18 years old or older. You need a valid credit card (except to the extent we permit purchases with gift cards, promotional or discount codes, or similar forms of payment), with full authority to use it, to submit an order for products or services through the Sites. You hereby represent and warrant that you will not use any credit card or other form of payment unless you have all necessary legal authorization to do so. You may be asked to supply certain information relevant to your transaction including, without limitation, your credit card number, the expiration date of your credit card, your billing address, and your shipping information. By submitting such information, you grant to us the right to provide such information to third parties for purposes of facilitating the completion of transactions initiated by you or on your behalf to purchase products or services from the Sites. You understand that we will not be liable in the event that others acting with or without your permission use your credit card to make purchases on the Sites. Certain products that you purchase and/or download on or through the Sites may be subject to additional terms and conditions presented to you at the time of such purchase or download.

PAYMENT PROCESSING

Payments are processed by RevenueCat (for mobile) and Stripe (for web).
By subscribing, you agree to RevenueCat's [Terms] and Stripe's

Termination and Modifications

(a) Termination. Pegasus Realm reserves the right to terminate your access to and use of the Sites at any time, in its sole discretion, without notice and liability, including, without limitation, if Pegasus Realm believes your conduct fails to conform with these Terms. We may also block your access to our Sites in the event that you (a) breach these Terms, (b) we are unable to verify or authenticate any information you provide to us, or (c) we believe that your actions may cause financial loss or legal liability for you, our users, or us. Pegasus Realm also reserves the right to investigate suspected violations of these Terms, including, without limitation, any violation arising from any e-mails you send to the Sites or Pegasus Realm. Any violation, or potential violation, of these Terms may be referred to law enforcement authorities.

(b) Modifications. Pegasus Realm reserves the exclusive right to modify, withdraw, suspend or discontinue, temporarily or permanently, at any time and from time to time, any Materials available on the Sites, without limitation, in whole or in part, including the cessation of all activities associated with the Sites, with or without notice. You agree that Pegasus Realm will not be liable to you or to any third party for any modification, suspension or discontinuance of the Sites or any part thereof.

(c) What happens upon Termination? Upon termination of your access to the Sites, or upon demand from Pegasus Realm, all rights granted to you under these Terms will cease immediately, and you agree that you will: (a) immediately discontinue use of the Sites, including links to the Sites; and (b) destroy all Materials obtained from the Sites and all related documentation.

Third-Party Service Disruptions: InkWell relies on third-party services
(e.g., Anthropic Claude AI, Firebase, Twilio). If these services become
unavailable, InkWell features may be degraded or discontinued. We are not
liable for service disruptions caused by third-party providers.

Governing Law, Arbitration and No Class Actions

Miscellaneous

The failure of Pegasus Realm to act with respect to a breach of these Terms by you or others does not constitute a waiver and will not limit Pegasus Realms’ rights with respect to such breach or any subsequent breaches. No waiver by Pegasus Realm of any of these Terms will be of any force or effect unless made in writing and signed by a duly authorized officer of Pegasus Realm. Neither the course of conduct between the parties nor trade practice will act to modify these Terms. Pegasus Realm may assign its rights and duties under these Terms to any party at any time without any notice to you. These Terms may not be assigned by you without Pegasus Realm’ prior written consent. If any provision of these Terms will be unlawful, void, or for any reason unenforceable, then that provision will be deemed severable from these Terms and will not affect the validity and enforceability of any remaining provisions. The Section titles are inserted only as a matter of convenience and have no legal or contractual effect. You agree that these Terms will not be construed against Pegasus Realm by virtue of having drafted them.

If any provision of these Terms is found unlawful in your jurisdiction, that
provision will be modified to the minimum extent necessary to make it
enforceable, or severed if modification is not possible. All other provisions
remain in effect.
